Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Stackr ("Stackr," "we," "us," or "our"), governing your access to and use of the Stackr website located at stackr.gg, including all associated features, services, and applications (collectively, the "Platform").

Stackr is a Looking For Group (LFG) platform designed to help gamers find and connect with teammates across titles including CS2, Apex Legends, Dota 2, League of Legends, PUBG, and Arena Breakout: Infinite. The Platform provides lobby creation, real-time messaging, direct messages, friend connections, player reviews and ratings, personalized recommendations, and Discord integration.

By creating an account, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Platform on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

Age Requirement

You must be at least 16 years of age to create an account and use the Platform. If you are between 16 and 18 years old (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and agrees to these Terms on your behalf. We do not knowingly collect personal information from anyone under the age of 16. If we discover that a user is under 16, we will promptly terminate their account and delete associated data.

Account Creation

You may register for Stackr using an email address and password, or by authenticating through Discord OAuth. Regardless of the registration method, you agree to provide accurate, current, and complete information. You are limited to one account per person. Creating multiple accounts to circumvent bans, manipulate ratings, or gain an unfair advantage is strictly prohibited.

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@stackr.gg if you suspect any unauthorized access to or use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

Discord Integration

If you choose to link your Discord account, you authorize Stackr to access certain information from your Discord profile as described in our Privacy Policy. You may unlink your Discord account at any time through your account settings. Unlinking Discord may limit certain Platform features that depend on Discord integration.

Acceptable Use

You agree to use the Platform only for its intended purpose: finding gaming teammates, creating and joining lobbies, communicating with other players, and building your gaming network. You will comply with all applicable local, national, and international laws and regulations while using the Platform.

You agree not to engage in any of the following activities on or through the Platform:

This list is not exhaustive. We reserve the right to determine, at our sole discretion, what constitutes a violation of these Terms and to take appropriate action, including warnings, temporary suspensions, or permanent bans.

Your Content

"User Content" refers to any content you create, upload, submit, or transmit through the Platform, including but not limited to lobby titles, lobby descriptions, chat messages, direct messages, player reviews, ratings, profile information, display names, and avatars.

License Grant

By submitting User Content to the Platform, you grant Stackr a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating, promoting, and improving the Platform. This license continues for as long as your User Content remains on the Platform and terminates when you delete your content or your account, except where your content has been shared with other users or where retention is required by law or legitimate business purposes (such as backup archives).

Content Standards

You are solely responsible for your User Content. You represent and warrant that your User Content does not violate any third party's rights (including intellectual property and privacy rights) and complies with these Terms, our Community Guidelines, and all applicable laws.

Content Removal

We reserve the right, but have no obligation, to monitor, review, and remove User Content at our sole discretion and for any reason, including content that we believe violates these Terms or is otherwise objectionable. We may also remove content in response to valid legal requests or to protect the safety of our users.

Stackr's Intellectual Property

The Platform, including its source code, design, user interface, graphics, logos, trademarks, service marks, and all other proprietary content (collectively, "Stackr IP"), is owned by or licensed to Stackr and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on any Stackr IP without our prior written consent.

Your Intellectual Property

You retain all ownership rights in your User Content. Nothing in these Terms transfers ownership of your User Content to Stackr. The license granted in Section 4 is limited to what is necessary for us to operate the Platform.

Game Titles & Trademarks

All game titles, logos, and trademarks referenced on the Platform (including CS2, Apex Legends, Dota 2, League of Legends, PUBG, and Arena Breakout: Infinite) are the property of their respective owners. Stackr is not affiliated with, endorsed by, or sponsored by any game publisher or developer unless explicitly stated.

Discord Integration

The Platform integrates with Discord for authentication and social features. Your use of Discord is subject to Discord's Terms of Service and Privacy Policy. We access only the Discord data you authorize and as described in our Privacy Policy.

Game APIs

The Platform may access publicly available game APIs to retrieve player statistics, rank information, or match data for supported games. The availability and accuracy of this data depends on the respective game publishers' APIs, and we make no guarantees about the completeness or timeliness of such data.

Third-Party Links

The Platform may contain links to third-party websites, services, or resources. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services. Your interactions with third-party services are solely between you and the third party.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and protect your personal information when you use the Platform. The Privacy Policy is incorporated into and forms part of these Terms. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

No Guarantees

We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of viruses or other harmful components. We do not guarantee that you will find teammates, that lobbies will fill, that other users will behave appropriately, or that the Platform will meet your specific expectations. We do not guarantee the accuracy of player statistics, rankings, or other data obtained from third-party game APIs.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STACKR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL STACKR'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO STACKR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

Indemnification

You agree to indemnify, defend, and hold harmless Stackr and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

Informal Resolution

Before filing any formal legal action, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Platform by contacting us at legal@stackr.gg. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If the dispute is not resolved within this period, either party may proceed with formal legal action.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

Waiver of Class Actions

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND STACKR EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND. ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS.

Termination by You

You may terminate your account at any time by using the account deletion feature in your profile settings or by contacting us at support@stackr.gg. Upon deletion, your profile, lobbies, and associated data will be removed from the Platform in accordance with our Privacy Policy. Some information (such as messages sent to other users and reviews you have written) may persist in anonymized form.

Termination by Stackr

We reserve the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, conduct that we determine is harmful to other users or the Platform, extended inactivity, or legal or regulatory requirements. We will make reasonable efforts to notify you of the reason for termination, but we are not obligated to do so where it would compromise security or an ongoing investigation.

Effect of Termination

Upon termination, your right to access and use the Platform ceases immediately. The following sections of these Terms shall survive termination: User Content (license grant for previously submitted content), Intellectual Property, Disclaimers & Liability, Dispute Resolution, and any other provisions that by their nature should survive.

We reserve the right to modify, amend, or replace these Terms at any time. When we make material changes, we will notify you by at least one of the following methods: posting a prominent notice on the Platform, sending a notification to the email address associated with your account, or displaying an in-app notification upon your next login.

The "Last Updated" date at the top of these Terms indicates when the most recent revisions were made. We encourage you to review these Terms periodically. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and delete your account.

For material changes that significantly affect your rights or obligations, we will provide at least fourteen (14) days' notice before the changes take effect, unless the changes are required by law or are related to new features or services.
